Federal Court Keeps Housing Counseling Funds From Expiring During Lawsuit

  • On September 30, a federal judge ordered HUD to keep $57.5 million in FY2025 housing counseling funds that were set to expire at midnight while a legal challenge proceeds
  • The National Urban League and nine other housing counseling organizations filed the suit after the administration requested that Congress cancel nearly all program funding. The organizations argue that congressionally approved funds cannot be withheld without congressional authorization.
  • Despite opposition from the Dept. of Justice, the judge ruled that the court has the authority to preserve the funds during litigation. The decision does not require HUD to distribute the funding or determine the lawsuit’s outcome
  • NEXT STEPS: The administration’s response is due tomorrow, October 9th, followed by the plaintiffs' reply on October 19th. From there, the court will decide if a hearing is necessary
